This suit was instituted in the district court of Bexar County by Noel Rogers against Texas Livestock Marketing Association, seeking to recover damages for personal injuries suffered by him as the result of being run into by some cattle while on the defendants premises at the Union Stockyards in San Antonio. The trial was to a jury and upon its answers to special issues submitted judgment was rendered in favor of plaintiff against defendant in the sum of $12,200, from which judgment the Texas Livestock Marketing Association has prosecuted this appeal.
